Wake County Drug Offenses and Underage Alcohol Possession

Most first time offenders charged with underage alcohol possession or misdemeanor drug possession are able to successfully earn a dismissal of the charge upon successful completion of a diversion program. The diversion program usually consists of attendance in a drug or alcohol education class. Upon dismissal, a record of the charge can be expunged from the offender's record.

In limited circumstances, first time felony charges for drug-related offenses can also be diverted through successful completion of a drug education program and community service. These diversion programs are only offered to first time offenders possessing small amounts of the drug, and they are a great way to keep the defendant's record clean. NC criminalizes possession of any amount of Cocaine, Ecstasy, Heroin and other harder drugs at the Felony level.
