Assaults

  • Whether an assault is charged as a misdemeanor or a felony is largely dependent upon the severity of the injury to the victim and whether a weapon was used.
  • NC defines assault as an overt act or attempt, or the unequivocal appearance of attempt, to physically injure another person.
  • Punishments are more severe where the victim is a female, a police officer or other government official such as a teacher.
  • Domestic Violence, or the acts of violence between individuals involved in a romantic relationship, may require that the offender complete a Domestic Abuser treatment program, get a substance abuse assessment, etc.
